In Indonesia, natural resources are under great pressure from both urban development and commercial exploitation. In Indonesia, natural resources are under great pressure from both urban development and commercial exploitation. In the Central regency of Seram Island, Maluku, oil palm plantations are extending in the North. Meanwhile, in the southern side a state-owned company of cocoa and rubber together with a private logging enterprise are exploiting the vast territory of Waraka, an ancestral village established on the coast. The set of customary laws and principles of this village, locally called Adat, is still very powerful and gives the basis to the traditional land tenure and land use systems. In order to work for the socio-economical development of his community, the King or Raja of Waraka deals with both companies within a dual and uncertain legacy framefork. The methodology is based on the institutional framework analysis developed by Ostrom (1994) and a preliminary literature review. It also encompasses qualitative interviews. It is shown that the evolution of the land tenure and land use systems of Waraka is relative to the strength of Adat’s recognition and on the ability of the Raja to conduct these deals with both companies. The study finally discusses the possibilities for all stakeholders to manage the land in a more sustainable way through the implementation of a treenursery program funded by credit carbons or the use of reduced impact logging practices.
En Indonésie, les ressources naturelles sont sous la forte pression de l’urbanisation et des exploitations commerciales. Dans la région centre de l’île de Seram, aux Moluques, les plantations de palmiers à huile s’étendent dans le nord, tandis que dans le sud une compagnie publique de cacao et de caoutchouc ainsi qu’une entreprise privée d’exploitation forestière développent leurs activités sur le vaste territoire de Waraka, un village ancestral établi sur la côte. L’ensemble des lois et principes coutumiers de ce village, ou Adat, demeure de forte influence et sert de base aux systèmes foncier et d’usage des terres traditionnels. Ayant pour objectif premier le développement socio-économique de son village, le Roi ou Raja de Waraka traite avec les deux compagnies au travers d’un flou juridique qui défend à la fois des intérêts nationaux et communautaires. A l’aide d’une méthodologie basée sur des entretiens qualitatifs et sur une étude bibliographique, il est démontré que l’évolution des systèmes foncier et d’usage des terres de Waraka dépend de la force de la reconnaissance attribuée à l’Adat et à l’habileté qu’a son représentant, le Raja, à mener à bien les négociations avec les deux entreprises. Leur adaptation est toutefois limitée par le pouvoir économique des exploitations commerciales et par le manque d’intervention de l’Etat. L’étude discute enfin des possibilités pour toutes les parties prenantes engagées dans l’utilisation des terres d’effectuer une gestion plus durable du territoire grâce à l’implentation d’un programme de pépinière financé par des crédits carbone ou encore par l’utilisation de pratiques d’exploitation forestière à faible impact.
